These Terms and Conditions govern your use of TelexicoSMS, an SMS marketing platform operated by Telexico Communications Ltd, registered in England and Wales, with offices at 64 Chapel Ash, Wolverhampton, WV3 0TY.
By accessing or using TelexicoSMS, you agree to be bound by these Terms. If you do not agree, please do not use the platform.
TelexicoSMS provides AI-powered SMS campaign management tools including bulk SMS sending, AI message generation, campaign rotation, opt-out management, and compliance tools for UK businesses.
We aim to provide continuous availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible.
To use TelexicoSMS you must register for an account. You agree to provide accurate, current, and complete information and to keep this information updated. You are responsible for maintaining the confidentiality of your account credentials.
You agree to use TelexicoSMS only for lawful purposes. You must not use the platform to:
You are solely responsible for ensuring your use of TelexicoSMS complies with all applicable laws including PECR, GDPR, and ICO guidelines. TelexicoSMS provides tools designed to support compliance but does not guarantee that your campaigns are legally compliant — compliance is your responsibility.
You must have a valid lawful basis for sending SMS messages to your contacts. You must maintain records of consent and honour opt-out requests promptly.
Every message sent through TelexicoSMS must include an opt-out instruction. The platform provides automatic opt-out suppression tools which you must keep active.
Pricing is charged on a pay-as-you-go basis from 3p + VAT per SMS. Volume pricing may be available. Full pricing details are available on the platform. We reserve the right to change pricing with 30 days notice.
TelexicoSMS and all related content, software, and technology are the property of Telexico Communications Ltd. You are granted a limited, non-exclusive licence to use the platform during your subscription. You retain ownership of your contact data and campaign content.
We process personal data in accordance with our Privacy Policy and applicable data protection law. You act as a data controller for your contact data. Please see our Privacy Policy for full details.
To the maximum extent permitted by law, Telexico Communications Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of TelexicoSMS. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.
Either party may terminate the service at any time. We reserve the right to suspend or terminate accounts that breach these Terms without notice. Upon termination, your right to use the platform ceases immediately.
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
